What is Force Majeure?

When an extraordinary event beyond the reasonable control of the parties occurs, which prevents one or both parties from fulfilling their obligations, a Force Majeure clause in a contract can free the parties from liability or from all or part of the obligations. Examples of these events or circumstances are:

  • War
  • Crime
  • Unforeseen legal changes
  • An ‘act of God’ or natural hazard outside human control

    The interpretation of the clause is controlled by the law of the country that is governing the Terms and Conditions.
